In a November 2022 opinion, the Dallas Court of Appeals re-affirmed the long-standing principle that pleading a routine or "garden-variety" claim for mental anguish as part of a personal injury or wrongdul death claim does not trigger an exception to the Mental Health Information provilege that would allow an opponent to peruse one's mental health care records.
