In a December 30, 2022 decision, the Texas Supreme Court issued a ruling holding Plaintiffs in a Texas Tort Claims Act case bear the burding of proving which of the caps in the statute is applicable to the case. The court reasoned that since the issue of immunity from suit/liability is jurisdictional and there are different caps in the statute the Plaintiff must plead and prove which cap applies.
